
GASTROCLUB MEMBERSHIP AGREEMENT
This GASTROCLUB MEMBERSHIP AGREEMENT (“Agreement”) has been entered into between GastroClub and the Member whose details are provided below.
1. PARTIES

GastroClub and the Member shall hereinafter be referred to individually as the “Party” and collectively as the “Parties.”
2. DEFINITIONS
2.1. GastroClub Mobile Application (Application): Refers to the mobile application that enables Campaigns created by GastroClub to be presented to Members and Members to benefit from these Campaigns within all pages/areas/sections/parts or categories created by GastroClub.
2.2. GastroClub Card: Refers to the mobile membership card used through the Application that enables Members to benefit from certain discounts, promotions, goods and/or services, and other campaigns (“Campaign”) offered by restaurants, companies, and organizations (“Member Business/Businesses”) affiliated with GastroClub.
2.3. GastroClub Membership: Refers to the Member's voluntary approval of the GastroClub Membership Agreement, the Information Text on the Protection of Personal Data, and the Express Consent CommunicationText in order to use the Campaigns, and the selection of one of the 1 (one)-month, 3 (three) month, 6 (six) month, and 12 (twelve) month packages (“Membership Package(s)”) and make the payment (“Membership Fee”) for the relevant package in a digital environment, after which the membership system begins with the campaigns becoming available for use within the Application.
2.4. Member: Refers to real and/or legal persons who are holders of a GastroClub Card and who meet the conditions of GastroClub Membership. (In this Agreement, they are also referred to as “User” in the stage prior to Membership.
2.5. Member Business or Member Businesses: Refers to real or legal persons, companies, or organizations operating in Turkey that are obligated to provide Campaigns to Members within the Application and are the providers of Campaigns.
2.6. Discount Card/Code: Refers to the digital discount card/code displayed on the page/area that opens after the Member logs into the page/area created for the relevant Member Business within the Application in order to benefit from the Campaigns.
2.7. GastroPay: Refers to the function used to collect payments from Members for Campaigns offered by Member Businesses, which involves adding a bank/credit card and making payments.
2.8. GastroPara: Refers to the digital amount that the Member will earn back from any transaction they make at Member Businesses where the GastroPay function is valid, specifically for the Campaign.
2.9. Card Custodian: Refers to a company based in Turkey that holds a PCI DSS Level 1 license and will provide bank/credit card held services within the application.
2.10. Account Balance: Refers to the digital account balance where GastroPara funds are accumulated and stored within the GastroPay function.
3. SUBJECT OF THE AGREEMENT
This Agreement, is entered into to determine the rights and obligations of the Parties in accordance with the provisions of the Consumer Protection Law No. 6502 (“CPL”) and other relevant legislation (collectively referred to as “Legislation”) regarding the User's ability to benefit from Campaigns by downloading the Application and fulfilling the GastroClub Membership conditions.
4. RIGHTS AND OBLIGATIONS OF THE MEMBER
4.1. Under this Agreement, the User who becomes a Member of the Application by fulfilling the conditions of GastroClub Membership acknowledges and declares that the GastroClub Card will be activated without any additional fees and that, in accordance with the provisions of this Agreement, the Member may only begin to benefit from the Campaigns offered within the scope of the Membership Package selected by the Member.
4.2. The Member acknowledges and declares that they have read and understood the preliminary information regarding the basic characteristics of the Application, GastroClub Membership, and GastroClub Card, as well as other related matters, as set forth in this Agreement and the Application; that they have obtained accurate and complete information regarding the basic features of the Application; and that they have provided the necessary electronic confirmations and approvals regarding these matters.
4.3. By accepting this Agreement, the Member obtains the right to view and use the Campaigns included in the Membership Package selected in the Application and acknowledges and declares that they may not transfer and/or allow the use of any of these rights to another person under any circumstances.
4.4. The Member may use the Campaigns within the Application using the methods specified below;
4.4.1. The relevant Campaign page is clicked, and the “Create GastroClub Card” button at the bottom of the page is clicked. When the Discount Card displayed on the screen is shown to the relevant Member Business employee, the Member Business employee collects the amount for the discounted service from the Member. The screen where the Discount Card is displayed shows the date of the day, a counter counting down from ten (10) minutes to zero (0), and the Member Business logo, name, and the discount rate offered by the Campaign. If the Campaign operates with a code, after clicking on the Campaign page, click on the “Get GastroClub Discount Code” button at the bottom of the page. The Campaign Code to be used at the Member Business appears on the screen that opens. The Member uses the relevant code in the Application according to the methods/rules specified in the Member Business's Campaign.
4.4.2. To earn GastroPoints at GastroPay locations, click on the “QR code button” on the relevant page. The camera opens (if camera permission has not been granted, camera access permission must be enabled in the App permissions section of the mobile phone settings). The QR code displayed on the Member Business's cash register screen/tablet screen is scanned, or the six-digit code on the Member Business employee's screen is entered by the Member in the relevant field in the App, and the payment is made. In order to make a payment, the Member must first register a bank/credit card in the Application. During the card registration process, a provisional charge of one (1) Turkish lira is deducted from the card and immediately refunded to the card to confirm that the card is active.
4.5. The Member acknowledges and agrees that different discount rates may be offered for each Membership Package available in the Application and/or that different Campaigns not included in the selected Membership Package may be available, and that the Member will not be able to benefit from such Campaigns not included in the Membership Package, and that the Member will not make any claims, objections, other claims, or allegations regarding this matter.
4.6. The Member acknowledges that the discount rates of certain Member Businesses may vary depending on the day and/or time, and that they will perform transactions by following the lunch/dinner discounts, weekday/weekend discounts, person limits, and/or other special conditions through the Application. and that GastroClub and/or the Member Business shall not be liable for any damages, losses, and/or other adverse consequences that may arise otherwise.
4.7. The Member acknowledges, declares, and undertakes that all transactions conducted using their information are exclusively carried out by themselves.
4.8. By becoming a GastroClub Card holder, the Member acknowledges, declares, and undertakes that they have read and understood these terms and conditions regarding the use of the Campaigns in the Application, that they are bound by these terms and conditions, and that they will comply with these terms and conditions as well as all applicable laws, regulations, and other legislation.
5. GASTROCLUB MEMBERSHIP PROCEDURES AND GASTROCLUB CARD USE
5.1. The Campaigns provided to the Member cannot be combined with other campaigns, promotions, and discounts made by the Member Business or authorized third parties/individuals at the Member Business (such as benefits provided by other club memberships, loyalty platforms, or organizations to the relevant person's bank/credit card or directly to the person).
5.2. The use of Campaigns during transactions made with cards issued by meal voucher companies operating in Turkey is at the discretion of the Member Business. The Member acknowledges and declares that they must obtain information about this from a Member Business representative before placing an order. If the Member has not obtained this information prior to placing an order, GastroClub and/or the Member Business shall not be held liable for any issues that may arise during the payment process.
5.3. Unless otherwise specified, Campaigns provided to Members under the GastroClub Card are not valid for delivery services.
5.4. The application is constantly updated to display all Member Businesses and participation conditions in a timely manner. GastroClub is not responsible for the consequences of any changes made by a Member Business to the participation conditions of Campaigns.
5.5. Members must make reservations at Member Businesses that require reservations by specifying their GastroClub Membership. The Member accepts that if they do not visit the Member Business in accordance with the rules applicable at the Member Business, their reservation may be invalidated at the discretion of the Member Business. In such cases, GastroClub has no liability. The reservation requirement is specified in detail on the relevant Campaign pages of the Member Business.
5.6. If the Member makes a payment using the GastroPay feature, they acknowledge and declare that the amounts involved in the transactions will be processed through GastroClub's digital POS and that they will not make any requests for cancellation, refund, etc. from the Member Business under any name, and that if the Member has any requests for refund, transaction cancellation, transaction dispute, etc. The Member agrees and declares that in the event of any such request, they must contact GastroClub through the GastroClub Call Center.
5.7. In the event of any questions, complaints, or requests/suggestions (“Requests”) regarding the Campaigns and the Member's payment transactions, the Member must submit their Requests via the info@gastroclub.com.tr, the GastroClub Call Center at 0850 304 10 83, and/or the “Contact Us” section within the Application. GastroClub accepts and declares that it will comply with the provisions of this Agreement and relevant legislation in such complaints and requests.
6. MISCELLANEOUS MATTERS
6.1. The photographs, addresses, and telephone numbers of Member Businesses displayed in the Application are for promotional and informational purposes only. GastroClub does not make any express or implied commitment or guarantee that these details accurately reflect the actual status of Member Businesses or the products and/or services they provide.
6.2. GastroClub may provide links to third-party websites and/or portals, files, or content related to Campaigns through the Application. These links may be provided by GastroClub for the purpose of ease of reference, with the permission of the owner. GastroClub does not endorse the aforementioned website or content owner, nor does it make any representations or warranties regarding the information contained on the website or content. GastroClub is not responsible for third-party portals, websites, files, and content accessed through the Application, or for the services, products, and/or content offered by these portals or websites.
6.3. GastroClub is responsible for technical malfunctions arising from the Application. It is not responsible for defects in extensions that provide access to websites and/or portals, files, or content operated by third-party individuals and/or legal entities beyond its control.
6.4. GastroClub will only act as an intermediary between the Member and the Member Business and will not be a party to the service relationship between the Member and the Member Business. GastroClub shall not be held liable for any defects arising from the services provided or products sold by the Member Business, or for any damages resulting from such defects, etc. In the event of any disputes, the Member hereby acknowledges, declares, and undertakes that they will not make any claims against GastroClub and that the sole party responsible is the Member Business.
6.5. GastroClub reserves the right to modify, reorganize, and terminate the Campaigns featured in the Application, including the benefits they offer, their terms of use, and the information provided on physical and virtual platforms, without prior notice or notification. Changes take effect upon publication by GastroClub.
6.6. Member Businesses and GastroClub are independent and separate commercial entities. GastroClub is a platform that brings Members and Member Businesses together and is in no way a provider, supplier, or agent of services, nor is it a partner, agent, dealer, representative, or in any way a commercial assistant of the Member Business.
7. CONFIDENTIALITY AND PROCESSING OF PERSONAL DATA
7.1. All information and documents shared between the Parties under this Agreement shall be deemed Confidential Information; personal data under the KVKK shall also be included within the scope of Confidential Information.
7.2. Confidential Information shall be processed by the Parties with the necessary technical measures and for the limited purpose of this Agreement; upon termination of this Agreement by the Parties, the data relating to the relevant Party shall be immediately deleted unless there is a legal necessity to retain it.
7.3. Even if the Member terminates this Agreement, if there is an Express Consent Communication approval, personal data will be processed and communication with the Member will be possible within the scope specified in the Express Consent Communication Text. Members who wish to change their communication preferences may do so by submitting a request through the GastroClub Call Center.
7.4. GastroClub will process the Member's personal data in order to provide the services under this Agreement; the details are specified in the Information Text on the Protection of Personal Data.
8. RESOLUTION OF DISPUTES
8.1. In the event of any dispute arising from this Agreement, the Istanbul Central (Çağlayan) Courts and Enforcement Offices shall have jurisdiction, and Turkish law shall apply to the dispute. In disputes arising from this Agreement, Consumer Arbitration Boards shall have jurisdiction up to the value announced by the Ministry of Customs and Trade, and Consumer Courts shall have jurisdiction above that value; in locations where there are no Consumer Courts, the Civil Courts of First Instance shall have jurisdiction.
8.2. The Parties hereby acknowledge and declare that, in the resolution of any disputes that may arise between them regarding this Agreement and its implementation, the Parties' books, records, and documents, as well as GastroClub's audio recordings and written instructions sent by the Member to GastroClub, shall constitute exclusive evidence in accordance with Article 193 of the Code of Civil Procedure No. 6100. They hereby acknowledge and declare that they will not offer each other an oath for the proof of any matter.
9. FORCE MAJEURE
Circumstances beyond the control of the Parties that prevent and/or delay the Parties from fulfilling their obligations under this Agreement shall be considered force majeure [strikes, lockouts, war, civil war, terrorist acts, riots, earthquakes, fires, floods, similar natural disasters, decisions and actions of the state, etc.]. and the Parties shall not be held liable for failure to perform their obligations in full or on time due to force majeure. The Member's inability to use the Application or some of its functions/features and/or Campaigns for a period of time due to the inability of the companies providing server services and/or payment services to GastroClub to provide their services shall also be considered as force majeure.
10. INTELLECTUAL PROPERTY RIGHTS
GastroClub; GastroClub Card, Application, GastroPay, and Discount Card (including but not limited to the general appearance, design, text, images, logos, icons, demonstrative, written, electronic, graphic, or machine-readable technical data, GastroClub trademarks, applied business methods and business models, software code, and other codes) All financial and moral rights (“Intellectual Property Rights”) belong to GastroClub and/or are used under copyright obtained by GastroClub from a third party.
All elements belonging to GastroClub and protected under Intellectual Property Rights, without limitation, may not be modified, copied, reproduced, translated into another language, republished, resold, shared, distributed, displayed, or licensed without prior permission and without citing the source. or used outside the scope of the Agreement, or derivative works may not be created or prepared. In the event of any violation of these provisions, the Member acknowledges, declares, and undertakes to be personally liable for any damages incurred by GastroClub and/or third parties, including licensors, and to compensate them without the need for a court decision.
11. TERM, TERMINATION, AND VALIDITY
11.1. GastroClub Membership is valid for the duration of the Membership Package selected by the Member. Upon the expiration of this term, GastroClub has the right to terminate this Agreement and suspend the use of the GastroClub Card and Campaigns without prior notice.
11.2. In the event that the Member fails to fulfill the obligations set forth in this Agreement and/or breaches this Agreement for any other reason, GastroClub shall have the right to terminate this Agreement immediately without any liability for compensation.
11.3. The Member has the right to terminate this Agreement at any time by “canceling their membership.” If the Member cancels their GastroClub Membership, any amount in their Account Balance will be deleted. The Member acknowledges, declares, and undertakes that they cannot request a refund if they cancel their Membership before the end of the period they have committed to.
11.4. If the Member uses the GastroPay service within the application, they acknowledge that their card information will not be custody by GastroClub as a “Card Custodian”, and that the bank/credit card information they have registered in the Application will be held by a third-party company licensed under PCI DSS Level 1 and located within the country. The Member also acknowledges, declares, and undertakes that they will not make any claims for rights or receivables from GastroClub in disputes related to GastroClub and/or Member Businesses.
12. OTHER PROVISIONS
12.1. GastroClub may, at its sole discretion and unilaterally, amend this GastroClub Membership Agreement or any of its provisions and any annexes thereto, as it deems appropriate, at any time and in any medium, by giving notice thereof in a manner that is not detrimental to the Member. The amended provisions of the Agreement shall become effective on the date of publication or, if a validity date is specified in advance, on the validity date; the remaining provisions shall remain in full force and effect and continue to produce their legal effects. This Agreement may not be amended unilaterally by the Member.
12.2. The Member and GastroClub are independent Parties. The approval and implementation of this Agreement by both Parties shall not give rise to any partnership, agency, or employer-employee relationship between the Parties.
12.3. All notices, requests, and other communications under this Agreement shall be made through the email and address information specified in this Agreement for GastroClub and the Member. The Parties acknowledge that such notifications shall have the same legal effect as a valid legal notice and that the communication addresses specified in this Agreement shall be deemed to be the legal notice addresses.
13. EFFECTIVE DATE
13.1. The Member declares, accepts, and undertakes that they have read, understood, and accepted all the provisions of this Agreement and that they confirm the accuracy of the information provided by the Parties.
13.2. This Agreement consists of fourteen (13) main articles and shall enter into force on the date the Member logs into the Application, approves this Agreement, the Privacy Notice, and the Consent Form, and makes the payment for the Membership Package.
13.3. This Agreement shall remain in effect under the conditions specified in Article 11.

Your personal data collected for the fulfilment of the above-mentioned Purposes are shared with the Republic of Turkey Revenue Administration, the Republic of Turkey Ministry of Finance, Tax Offices, independent audit companies, medical consultants, contracted lawyers, consultants we use, technical service providers, etc. to our suppliers, legally authorized public institutions and legally authorized private persons within the scope of clearly stipulated in the laws and fulfilment of our legal obligations, to the analytical companies from which services are provided on the grounds of the use of cookies and cookie-like technologies in Webview and to the companies resident in the country where we receive server services.
Method and Legal Grounds for Collecting Personal Data
Your personal data may vary depending on the service, product or commercial activity provided by GastroClub within the scope of fulfilling the above-mentioned Purposes; It is collected by automatic or non-automatic methods, through the website, GatroClub application, filling out the online application form, call center, our mobile applications, social media channels, text messages, e-mail channels and interviews, visits and printed forms in cases where you contact the Company in a physical environment. In addition, your personal data may also be processed when you use our call center or website with the intention of using a certain GastroClub online services, when you participate in competitions, trainings, seminars or organizations organized by GastroClub, or when you visit or browse the websites. Your personal data is collected and processed by our Company for the following purposes and legal reasons based on the personal data processing conditions specified in Articles 5 and 6 of the Law.
Based on the legal ground that the processing of personal data of the parties to a contract is necessary, if it is directly related to the conclusion or performance of the contract;
Based on the legal reason that it is clearly stipulated by law and that it is mandatory for the data controller to fulfil its legal obligation;
Based on the legal reason that data processing is mandatory for the legitimate interests of the data controller, if it does not harm the fundamental rights and freedoms of the data subject;
Based on the legal reason that data processing is mandatory for the establishment, exercise or protection of a right;

İşbu sözleşmenin (“Sözleşme”) konusu, GastroClub üyesi’nin İnternet Sitesi’nden elektronik ortamda sipariş vererek GastroClub Kart’ı satın alması ve işbu Sözleşme Madde 3 kapsamında tanımlanan GastroClub üyesi olması ile ilgili olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun (“TKHK”) ve diğer ilgili mevzuat hükümleri uyarınca (topluca “Mevzuat” olarak anılacaktır) Taraflar’ın hak ve yükümlülüklerinin saptanmasıdır.
GastroClub üyelik Sistemi: İşbu Sözleşme’de belirlenen bedel karşılığında GastroClub Plastik Kart’ın GastroClub üyesi’ne teslim edilmesiyle veya GastroClub Mobil Uygulaması aracılığıyla GastroClub Mobil Kart’ın kullanıma hazır hale gelmesiyle başlayan GastroClub üyelik sistemini ifade eder.
GastroClub Mobil Uygulaması: Akıllı telefonlarda çalışabilen, İnternet Sitesi kapsamında kullanıcıların GastroClub Kart’ı satın alarak GastroClub üyesi olabilecekleri ve GastroClub üyeleri’nin aşağıda tanımlanmış olan GastroClub Mobil Kart’ı kullanabilecekleri mobil uygulamayı ifade eder.
GastroClub Kart: İşbu Sözleşme kapsamında, GastroClub tarafından, GastroClub üyesi’nin İnternet Sitesi’nde belirtilen restoran, şirket ve kuruluşlar nezdinde indirimlerden, promosyonlardan ve sair kampanyalardan faydalanmasını sağlayan, GastroClub üyesi’ne satılıp veya GastroClub’ın işbirliği içinde olduğu bir kurum tarafından fiziki ortamda teslim edilen üyelik kartını (“GastroClub Plastik Kart”) veya Iphone, Android telefonlar ve tablet bilgisayarlar aracılığıyla GastroClub Mobil Uygulaması üzerinden satın alınan ve sanal ortamda GastroClub Mobil Uygulaması üzerinden kullanılan mobil üyelik kartını (“GastroClub Mobil Kart”) ifade eder. İşbu Sözleşme kapsamında kullanılan “Ürün” ifadesi de GastroClub Kart’ı ifade eder. GastroClub üyesi, GastroClub üyelik Sistemi’ne üye olmak için, GastroClub Plastik Kart’tan veya GastroClub Mobil Kart’tan birini seçer.
GastroClub üyesi/Üyeleri: İşbu Sözleşme kapsamında GastroClub’dan GastroClub Kart’ı satın alan ve işbu Sözleşme’de yazılı üyelik koşullarını yerine getiren GastroClub Kart sahibi gerçek ve/veya tüzel kişileri ifade eder.
İnternet Sitesi: www.gastroclub.com.tr alan adı altında bulunan web sitelerini ifade eder.
Üye İşyeri/İşyerleri: İnternet Sitesi’nde belirtilen indirim, promosyon ve sair kampanyaları GastroClub üyeleri’ne ve GastroClub üyeleri’nin beraberinde bulunan kişilere sağlama yükümlülüğü altında bulunan gerçek veya tüzel kişiyi ifade eder.
İşlem: GastroClub üyeleri ile üye İşyeri arasında gerçekleşen her türlü ürün ve hizmet ilişkisini ifade eder.
“Satım Bedeli”: İşbu Sözleşme konusu GastroClub Kart’ın GastroClub üyesi’ne satış fiyatını ifade eder.
Taraf: GastroClub ile GastroClub üyesi’nden her biri anlamına gelir; GastroClub ile GastroClub üyesi topluca Taraflar olarak anılırlar.
GastroClub Mobil Kart’ın bedeli KDV ve kargo dahil kullanıcının satın aldığı pakete göre değişiklik gösterir. Üye tarafından GastroClub Mobil Kart’ın satın alımı halinde KDV dahil toplam üyelik bedeli https://gastroclub.com.tr/Account/Register web adresinden veya GastroClub Mobil Uygulamasından seçilen ödeme şekilleri çerçevesinde kredi kartıyla veya eft/havale vasıtasıyla ödenebilir.
GastroClub Üyesi, GastroClub Üyelik Sistemi’nin aktif hale gelerek üyelik sürecinin başlaması ile birlikte PayU’nun sunmakta olduğu “tekrarlanan ödeme” (recurring payment) özelliğinin yürürlüğe gireceğini ve GastroClub üyesi tarafından Sözleşme feshedilmediği veya Üye’nin gastroclub.com.tr sitesinde kullanıcı girişi yapılarak profil sayfasında yer alan söz konusu “tekrarlanan ödeme” (recurring payment) özelliği manuel olarak kapatılmadığı müddetçe, işbu Sözleşme’nin başta satın alınan paketin süresi kadar sürelerle uzayacağını ve bu durumda her sene ilgili GastroClub üyelik bedelinin vadesinde ve GastroClub tarafından sunulan taksit seçeneklerinden biri seçilerek kredi kartından otomatik olarak çekileceğini peşinen kabul, beyan ve taahhüt eder.
GastroClub Mobil Kart, başarılı satın alma işlemi tamamlandığı anda kullanıma hazır hale gelir ve GastroClub üyesi bunu takiben GastroClub üyelik Sistemi hizmetlerinden yararlanmaya başlayabilecektir.
GastroClub, söz konusu şikayet ve taleplerde işbu Sözleşme, Ön Bilgilendirme Formu ve ilgili mevzuat hükümlerine uyacaktır.
Mesafeli Sözleşmeler Yönetmeliği Madde 12 uyarınca GastroClub, tüketici sıfatını haiz GastroClub üyeleri’nin cayma hakkını kullandığına ilişkin bildiriminin kendisine ulaştığı tarihten itibaren 14 gün içinde, varsa GastroClub Kart’ın tüketiciye teslim masrafları da dâhil olmak üzere tüketici sıfatını haiz GastroClub üyesi’nden tahsil edilen tüm ödemeleri iade etmekle yükümlüdür.
GastroClub üyesi, GastroClub tarafından kendisine işbu Sözleşme konusu ile ilgili olarak gönderilecek her türlü ticarî elektronik iletilere, SMS ve sair gönderimlere onay vermektedir. Bu kapsamda GastroClub üyesi, GastroClub tarafından kendisine, kişi müdahalesi olmadan çalışan faks, elektronik posta, kısa mesaj gibi otomatik arama sistemleri vasıtasıyla, uygulama ve/veya İnternet Sitesi üzerinden anlık iletiler (push notifications) vasıtasıyla ve/veya benzeri başkaca iletişim vasıtaları ile GastroClub üyesi’nden herhangi bir ön izin alınmaksızın bilgilendirme, pazarlama, promosyon, kampanya ve/veya reklam amacıyla her türlü elektronik ileti, kısa mesaj, faks vs. gönderilebileceğini kabul ve beyan eder.
İşbu Sözleşme Taraflar arasında 18/7/2018 tarihinde akdedilmiştir.
GastroClub, dilediği zaman işbu sözleşme hükümlerinde değişikliğe gidebilir, değişiklikler, sürüm numarası ve değişiklik tarihi belirtilerek İnternet Sitesi ve/veya GastroClub Mobil Uygulaması üzerinden yayınlanır ve aynı tarihte yürürlüğe girer.
GastroClub üyesi’nin aşağıda yer alan kimlik ve iletişim bilgileri; işbu Sözleşme’nin internet ortamında yapılması hâlinde GastroClub üyesi tarafından elektronik ortamda doldurulacaktır.



(i) Visa Çözümü yalnızca aşağıdaki koşulları sağlayan kişilerce kullanılabilir:
(ii) 18 yaş üstü ve yürürlükteki mevzuat uyarınca Visa Çözümü’nün kullanımı için öngörülen tüm şartları sağlayan;
(iii) Bilgisayar veya başka bir cihaz aracılığıyla internet erişimi olan; ve
(iv) Bir veya birden çok Uygun Kart sahibi veya yetkili kullanıcısı ve Uygun Kart hesapları iyi durumda olan;
(v) Tüzel kişi adına hareket ediyorsa, en azından Visa Çözümü’nü kullanmak ve işbu Koşullar’ı onaylamak için tüzel kişiyi temsil yetkisi olan kişiler.
a. Bildirimler.



GC YEME İÇME HİZMETLERİ ANONİM ŞİRKETİ [Mersis Numarası- 0389072963100019] (“GastroClub” ya da “Şirket”) tarafından, 6698 Sayılı Kişisel Verilerin Korunması Kanunu’nun (“KVK Kanunu”) ilgili hükümlerine uygun olarak sunulan genel Kişisel Verilerin Korunması Kanunu Kapsamında Aydınlatma Metni ve Gizlilik ve Kişisel Verilerin Korunması Politikası çerçevesinde;
Şirket tarafından alınan tüm kişisel verilerimin, şirket tarafından belirtilen amaçlarla bağlı kalmak kaydıyla, iş geliştirme hizmetlerinin sağlanması, istatiksel ve teknik hizmetlerin temini ve müşteri ilişkilerinin yürütülmesi, uygulama için gerekli ödeme altyapısının sağlanması ile müşteri datalarının tutulması, arşivleme ve depolama amacıyla yurtdışında bulunan iş ortaklarına ve hizmet sağlayıcılarına gereken güvenlik önlemlerinin alınması ile aktarabilecek olup, burada işleme faaliyetine tabi tutulup saklanabilecektir. Çağrı merkezi süreçlerinin yönetilmesine ilişkin hizmetlerin sürdürülebilmesi amacıyla şirket çalışanlarına, görevlilerine, yurtdışı/uluslararası grup şirketlerine (Şirket ve/veya iş ortaklarına, hissedarlarına), kanunen yetkili kamu kurum ve kuruluşlarına, faaliyetlerini yürütebilmek amacıyla, hukuki zorunluluklar ve yasal sınırlamalar çerçevesinde yurtdışı/uluslararası bağımsız denetim şirketlerine, yurtdışı bilişim teknolojileri desteği alınan sunucular, hosting ve altyapı sağlayıcı şirketlere, program, bulut bilişim gibi elektronik ortamlara, tarafıma verilecek hizmetlerin ve/veya faaliyetlerin yürütülmesi için Şirket’in hizmet aldığı veya birlikte çalıştığı Avrupa Birliği üyesi bir ülkede ve Amerika Birleşik Devletleri’nde bulunan iş ortaklarına, hizmet sağlayıcılarına aktarılabileceğini ve bu kapsamda kişisel verilerimin yurtdışına aktarılmasına açık rızam olduğunu kabul ve beyan ederim.
Ayrıca, Şirket ile paylaşmış olduğum kişisel verilerin doğru ve güncel olduğunu; işbu bilgilerde değişiklik olması halinde değişiklikleri Şirkete bildireceğimi kabul ve beyan ederim.
KVK Kanunu kapsamında kişisel verilerimin işlenmesine, ilgili süreç kapsamında açıklanan işlenme amacı ile sınırlı olmak üzere kullanılmasına ve paylaşılmasına, gereken süre zarfında saklanmasına açık rızam olduğunu ve bu hususta tarafıma gerekli aydınlatmanın yapıldığını; işbu metni, Gizlilik ve Kişisel Verilerin Korunması Politikası ve Aydınlatma Metnini okuduğumu ve anladığımı kabul ve beyan ederim.
